California AB 1043: Digital Age Assurance Act
Issue: Device-Based AV
Latest Action: Passed Senate committees on August 29, 2025
Device manufacturers and app stores would be required to collect a user’s birthdate or age and provide an API for apps and websites to determine whether a user is under 18 years old. Platforms must use the age information to “manage the deliver of age-appropriate content.” Negligent violations are subject to fines of up to $2,500 per child; the fine for intentional violations is up to $7,500 per child.
Note: the requirement to make the API available to websites was removed from this bill.
