Websites must age verify users if more than 33% of the “total amount of data publicly available” on the site is pornographic.

Age verification mechanisms allowed:

  • digital ID
  • “A method that is commercially reasonable given a person’s scope of business and that relies on transactional data to verify an individual’s age”
  • A method approved by the attorney general by rule

Enforcement: the state attorney general may bring a civil action for up to $10,000 per day in violation of the law.

The bill requires the attorney general to adopt rules to implement and administer the bill.
