Age verification mandate. Relevant features:

  • Applies to “website[s] for which it is in the regular course of the trade or business of the entity to create, host, or make available” material harmful to minors.
  • Enforcement: private lawsuits
  • Age verification mechanisms allowed:
    • State-issued driver’s license
    • State-issued identification
    • Government identification card
    • Military identification card
    • Credit cards, not including cards that do not require the individual in ownership of the account to be eighteen years of age or older
    • Debit cards, not including cards that do not require the individual in ownership of the account to be eighteen years of age or older
    • Bank account information.
    • Any other means or method that reliably and accurately can determine a user of a covered platform is a minor and prevent access by minors to the content on a covered platform.
