Age verification mandate. Relevant features:

  • Enforcement: private right of action to recover:
    • Damages of ten thousand dollars ($10,000) per instance that the covered platform failed to perform age verification to restrict the minor's access to matter harmful to minors; and
    • Actual damages, court costs, and reasonable attorney's fees.
  • Age verification mechanisms allowed
    • Identification issued by any agency of the United States government or the Kentucky National Guard that establishes age;
    • Identification issued by a public or private college, university, or postgraduate technical or professional school located within the United States that establishes age;
    • Verification through an independent, third-party age verification service that compares the personal information entered by the individual who is seeking access to the matter with information that is available from a commercially available database, or aggregate of databases, that is regularly used by government agencies and businesses for purposes of age and identity verification;
    • Any commercially reasonable method of identification that relies on public or private transaction data to verify that the person attempting to access the matter is at least eighteen (18) years of age or older, including but not limited to a mortgage document or utility bill, or other reliable document that establishes age
