This bill was taken directly from the anti-porn groups’ playbook.
It requires any site containing content with nudity or sexually-explicit conduct (”actual or feigned”) to verify each person depicted is an adult and obtain explicit written consent for the performance of sexual acts and the distribution of the content using a form created or approved by the state Attorney General.
The bill defines “coerced consent” as consent obtained through “exploiting or leveraging the person’s…economic circumstances.”
Platforms must also:
- Display clear instructions for how someone can request removal of nonconsensual content.
- Designate staff responsible for handling these requests.
- Remove images within 72 hours of when a report is made.
- Fully block removed content and any edited versions from being re-uploaded.
- Allow performers to request removal of their own images at any time, regardless of prior consent or age.
Violations of the law are Class 1 misdemeanors subject to up to $10,000 per day for violations, beginning 24 hours after notice from the Attorney General. Persons depicted in the content can also sue for either actual damages or $10,000 per day per image.
The bill would take effect December 1, 2025 and apply retroactively.
