SB 593 defines unlawful pornography to include any depiction, image, or film that shows sexual intercourse which is normal or perverted, anal sodomy, sexual activity with an animal, sadomasochistic abuse, flagellation or torture, physical restraint such as binding or fettering in the context of sexual conduct, fellatio or cunnilingus, excretion in the context of sexual conduct, lewd exhibition of the uncovered genitals in the context of masturbation or other sexual conduct, and lewd exhibition of the uncovered genitals, buttocks, or, if such person is female, the breast, for the purpose of sexual stimulation of the viewer.

The measure authorizes any person to bring action against any person who produces or distributes such items and knowingly engages in conduct that aids or abets the production or distribution of unlawful pornography. The measure provides that a person prevailing in his or her claims shall be entitled to $10,000.00 for each image as well as court costs and attorney fees. Persons who distribute unlawful pornography shall be subject to a term of imprisonment not more than 10 years and/or a fine of $100,000.00. It also provides heightened 10-to-30-year criminal penalties for organized pornography trafficking.

The measure authorizes spouses to send such images to each other.
