Age verification mandate. Relevant features:

  • Enforcement: private lawsuits (up to $5,000 for each instance in which the commercial entity distributes or makes available sexual material harmful to minors to an individual under 18 years of age)
  • Age verification mechanisms allowed:
    • Using information stored on a digital network that positively identifies individuals and the birth dates of the individuals in a manner that is minimally sufficient for the purposes of authorizing payment in a commercial transaction or for the purposes of receiving benefits from a governmental agency; or
    • Complying with the requirements of a commercial system that verifies age using:
      • Government-issued identification; or
      • Public or private transactional data.
