Texas SB 3003

Texas SB 3003 prohibits the online sale of “obscene devices” to minors and mandates age verification at the point of sale. ("Obscene device" is defined by Texas law as “a device including a dildo or artificial vagina, designed or marketed as useful primarily for the stimulation of human genital organs.”)

Age Verification Methods Prescribed

• Government-issued ID
• Third-party age verification services using public records
• Restricted payment methods (e.g., credit cards requiring users to be 18+), but only if combined with another verification method

Penalties for Noncompliance: Class A misdemeanor and civil penalties up to $5,000 per violation.

Effective Date: September 1, 2025
