West Virginia HB 4412 requires websites containing more than 33-1/3% material harmful to minors to age-verify users via government ID or transactional data. The state Office of Technology is authorized to create rules governing the specifics of how age verification must be performed.
The bill creates a private right of action to pursue actual damages, plus up to $10k per violation. The state attorney general may also bring an action against suspected violators for $10k per day of violation, plus up to $250k if a minor is able to access the material.
