West Virginia SB 628 would require commercial entities that publish material harmful to minors on the internet to verify the age of a user before allowing them access to access it. The bill creates a private right of action to sue entities that violate the law.

The bill exempts interactive computer services, which it defines as “an information service, system, or access software provider that provides or enables computer access by multiple users to a computer server, including a system that provides access to the Internet and cellular phones."
