WY HB 72 broadens existing Wyoming obscenity law to clearly apply to physical items, digital content, and live performances, regardless of how they are delivered. It also creates the crime of “promoting obscenity to a minor” for the knowing distribution or dissemination of “material harmful to minors” to a person under 18 “in any possible way or method”.

The definition of “material harmful to minors” is extremely vast and includes, for instance, mere nudity and “sexual or gender‑oriented material that knowingly exposes minors to persons who are dressed in sexually revealing, exaggerated or provocative clothing or costumes, or are stripping, or engaged in lewd or lascivious dancing.”

Promoting obscenity to a minor is a misdemeanor punishable by imprisonment for not more than one (1) year, a fine of not more than six thousand dollars ($6,000.00), or both.
